As a response to a catastrophic
earthquake and its devastating consequences, on January 15,
2010 , United State Citizenship and Immigration Services (USCIS)
designated Haitians in the United States as eligible for Temporary
Protected Status (TPS).
What is TPS?
TPS is granted by the
Secretary of Homeland Security to eligible nationals of a certain
country (or persons without nationality who last habitually
lived in that country) who have experienced temporary negative
conditions, such as armed conflict, environmental disaster,
or extraordinary and temporary conditions. Providing a temporary
refugee for Haitian nationals who are currently in the United
States and whose personal safety would be endangered by returning
to Haiti is to support Haiti 's recovery. TPS designation would
allow eligible Haitians in the US to lawfully stay and work
in the US for a period of 18 months.
Eligibility
USCIS only gave Haitians
180 days to apply for TPS, therefore they must submit their
applications before July 20 of 2010; late filings will not be
accepted by USCIS. To be eligible for TPS, USCIS requires applicants
to meet certain requirements:
applicant
must be a national of Haiti or be a person without nationality
who last habitually resided in Haiti ;
continuous
residence in the US since January 12, 2010 ;
meeting
certain immigrant admissibility requirements;
satisfactory
completion of all TPS application procedures.
